1. Scope of Application

This Return and Refund Policy applies to purchases made remotely through the website www.agriassay.com

by consumers pursuant to Article 3 of the Italian Consumer Code.

“Consumer” means any natural person acting for purposes unrelated to any business or professional activity they may carry out.

2. Right of Withdrawal

Pursuant to Articles 52 et seq. of the Consumer Code, the consumer has the right to withdraw from the contract within 14 days without providing any reason.

AgriAssay voluntarily extends this period to 30 days from the date on which:

· the consumer acquires physical possession of the goods; or

· a third party, other than the carrier and designated by the consumer, acquires possession of the goods

3. How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, the consumer must inform AgriAssay by means of an explicit declaration, to be sent to:

The communication must include at least:

· full name

· order reference

· product description

· explicit statement of the intention to withdraw

The consumer may use the standard withdrawal form set out in Annex I, Part B of the Consumer Code (not mandatory).

4. Effects of Withdrawal

In the event of a valid withdrawal:

· the consumer must return the goods within 14 days from the communication of withdrawal;

· AgriAssay will issue a refund within 14 days from receipt of the goods or from proof of shipment, whichever occurs first.

The refund includes the standard initial delivery costs (where applicable), but not any additional costs resulting from delivery methods other than the standard one.

5. Refund Method

The refund will be made using the same payment method used by the consumer for the initial transaction, unless otherwise agreed.

No fees will be charged for the refund.

AgriAssay reserves the right to withhold the refund until the goods have been received or until the consumer has provided proof of their return.

6. Condition of Returned Goods

The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.

To be accepted, the goods must:

· be returned intact and complete

· be, where possible, in their original packaging

· show no signs of improper use or damage

7. Return Costs and Responsibility

Unless otherwise agreed, the direct costs of returning the goods shall be borne by the consumer.

The consumer is responsible for the shipment until it is received by the Controller.

AgriAssay is not responsible for loss or damage during transport.

8. Exclusions from the Right of Withdrawal

Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded for:

· goods made to measure or clearly personalized

· goods liable to deteriorate or expire rapidly

· sealed goods that are not suitable for return for health protection or hygiene reasons and were unsealed after delivery

· goods which, after delivery, are inseparably mixed with other items

· services already fully performed with the consumer’s express consent

9. Damaged or Defective Products

The consumer’s rights under Articles 128–135 of the Consumer Code regarding the legal guarantee of conformity remain unaffected.

In the case of defective or non-conforming products, the consumer is entitled to:

· repair or replacement

· price reduction or termination of the contract

10. Abuse Prevention

AgriAssay reserves the right to refuse returns that are:

· not compliant with these conditions

· fraudulent or abusive

· made in violation of applicable regulations

11. Applicable Law and Jurisdiction

This Policy is governed by Italian law.

For disputes with consumers, jurisdiction lies with the court of the consumer’s place of residence or domicile, pursuant to Article 66-bis of the Consumer Code.
